Copyright & DMCA Policy
Mojo Systems respects the intellectual-property rights of others and expects its users to do the same. This page explains how to report copyright infringement and how we handle notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Reporting alleged infringement
If you believe content available through the Services infringes a copyright you own or control, send a written notice to our Designated Agent that includes:
- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material you claim is infringing, with enough information for us to locate it (for example, the capture-page URL);
- Your contact information (name, mailing address, telephone number, and email);
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.
Designated Agent
Under 17 U.S.C. § 512(f), you may be liable for damages if you knowingly materially misrepresent that material is infringing.
How we respond
When we receive a valid notice, we will remove or disable access to the identified material and make a good-faith effort to notify the user who provided it. We record valid notices as part of our repeat-infringer records.
Counter-notification
If you believe your material was removed by mistake or misidentification, you may send a counter-notice to the Designated Agent that includes: your signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, mailing address, and telephone number; and a statement that you consent to the jurisdiction of the federal court for your judicial district (or, if outside the U.S., the district where Mojo Systems is located) and will accept service of process from the party who filed the original notice. If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant first files a court action seeking to restrain the activity.
Repeat infringers
In appropriate circumstances and at our discretion, we disable or terminate the accounts of users who are repeat infringers.
